In the debate over the Postville immigration raid, a lot of people are saying, "We have to enforce our laws," and everyone seems to take it for granted that Immigration and Customs Enforcement officials are enforcing the law. I wouldn't be so sure. Last year's U.S. attorney firings showed that the Bush administration is committed to politicizing federal law enforcement, and early evidence suggests that ICE might be selectively enforcing the law to help a loyal Bushie - Agriprocessors owner Aaron Rubashkin - in an organized labor fight in which neither side respects our immigration laws.........
There could be innocent reasons for this discrepancy - it could take more time to collect evidence for a conspiracy charge, for example - but we shouldn't assume the reasons are innocent. The Bush administration has a history of politicizing federal law enforcement, having fired seven U.S. attorneys who either prosecuted a Republican or didn't prosecute a Democrat aggressively enough. The administration probably has even tighter control over ICE than it has over U.S. attorneys, given that Bush founded ICE in 2003.

Rubashkin is a Republican. He has donated over $20,000 to the Republican party, and his family members have donated some as well. Senator Charles Grassley received a total of $8,000 from the Rubashkin family. So if ICE chooses not to prosecute Rubashkin or his managers, when they have clear evidence of the managers' guilt, we shouldn't assume ICE is enforcing the law diligently.

Rubashkin Campaign Donations – Just A Coincidence?

AgriProcessors leader Sholom M. Rubashkin has quite an interesting family.

His brother-in-law, Rabbi Milton Balkany, has been in the news for misappropriating almost one million dollars of Federal money meant for disabled students and for his habit of "bundling" campaign donations that has earned him the nickname "The Brooklyn Bundler."

Now it appears that the Rubashkin-Balkany clan has thrown their weight behind Florida politician Katherine Harris, who is of course famously close to Florida's governor Jeb Bush and the governor's brother, President George W. Bush.

What's curious is the timing of the donations.

It seems they were made just at the time the USDA was supposed to announce the findings of its investigation into AgriProcessors.

Tax economist Martin Sullivan suspects that Senator Obama will go for the "low-hanging fruit" first – that is, chasing down wealthy tax
evaders, individual and corporate. Obama signed on to the Tax Haven Abuse Act, a bill introduced in 2007 by Sens. Carl Levin (D) of Michigan and Norm Coleman (R) of Minnesota.

Senator Levin figures that secretive offshore tax havens cost the federal government $100 billion in lost tax revenues each year. That's part of the total "tax gap" – the amount of unpaid taxes owed by individuals, corporations, and other organizations – estimated by the Internal Revenue Service (IRS) to be $345 billion.

NEW YORK (JTA) -- In laying the legal groundwork for a massive raid of the country's largest kosher slaughterhouse, federal authorities cited claims that illegal narcotics production took place at the factory and hundreds of illegal immigrants were employed there, including several of the rabbis responsible for kosher supervision.

The charges were among the most explosive details to emerge following the raid Monday at the Agriprocessors plant in Postville, Iowa.

Agents arrested 390 workers in what Immigration and Customs Enforcement called the largest raid of its kind in U.S. history.

The raid, which required federal authorities to rent an expansive fairground in nearby Waterloo to house detainees, prompted the U.S. District Court for the Northern District of Iowa to temporarily relocate judges and court personnel to the site because the facilities in Cedar Rapids and Sioux City were inadequate.

"There have been other operations where more people have been arrested," Tim Counts, an Immigration and Customs Enforcement spokesman, told JTA. "But as far as we can determine, this is the largest single-site operation as far as number of arrests go."

The raid follows a six-month investigation involving more than a dozen federal agencies, including the Federal Bureau of Investigation, the Drug Enforcement Administration, the Internal Revenue Service, and the departments of labor and agriculture.

Three Israelis and four Ukrainians were among the detainees held on charges of being in the country illegally, Counts said. Officials are expected to bring criminal charges against some of the detainees as
well, most of whom are from Guatemala and Mexico.

Agriprocessors said in a statement Tuesday that it "takes the immigration laws seriously" and intended to "continue to cooperate with the government in its investigation."

"Agriprocessors will also inquire further into the circumstances that
led to these events," the company said. "We extend our heartfelt
sympathies to the families whose lives were disrupted and wish them
the best. We are deeply committed to meeting the needs of all of our
customers and are operating again today."

In the affidavit filed as part of the 60-page application for a search
warrant, additional details were revealed of the government's
investigation of Agriprocessors, a company that has been beset by
numerous allegations of health and safety violations, mistreating
workers and using controversial slaughter practices.

According to the document, a former supervisor at the plant --
identified only as Source #1 -- told investigators that some 80
percent of the workforce was illegal.

The source also said he believed rabbis responsible for kosher
supervision entered the United States from Canada without proper
immigration documents. According to the affidavit, the source did not
provide evidence for his suspicions about the rabbis.

Source #1 also claimed to have discovered active production of the
drug methamphetamine at the plant and reported incidents of weapons
being carried there.

Methamphetamine, more commonly known as crystal meth, is Illegal in
the United States. The popular nightclub drug gives users a sense of
energy and euphoria that can last for hours.

Agriprocessors employees told investigators that sometimes they were
required to work nighttime shifts of 12 hours or more........

Founded by Brooklyn butcher Aaron Rubashkin,Agriprocessors produces
kosher meat and poultry marketed under the labels Aaron's Best and
Rubashkin's.

The firm gained national attention in 2000 with the publication of the
book "Postville," which described the tensions between the company and
the local community. The company has attracted a significant
population of Orthodox Jews to a rural pocket of northeast
Iowa.........
The affidavit says the government has probable cause to believe that
an Agriprocessors supervisor assisted workers in acquiring fake
documents in exchange for a cut of the proceeds.

Federal investigators provided documentation for a former
Agriprocessors employee, identified in the affidavit as Source #7, for
the purpose of gaining employment at the plant. Once hired, the source
reported on rabbis who insulted the workers and threw meat at them.

In one alleged instance, a "Hasidic Jew" duct-taped a worker's eyes
and then hit him with a meat hook,

problems. Some eighty percent of their employees were in the country

refered to deroatorily as 'wet backs') smuggled in from Canada
apparently to bless Agriprocessor's methamphetamine
production. Many of the employees at Aaron's Best Kosher animal
torture sweatshops were children. Not only were its employees and
children illegal(they)were exploited to the maximum extent possible.
Illegals were paid less than Iowa minimum wage. Then of course they
were required to rent the slum properties of their...plant
supervisors. But financial abuse was not the only abuse these poor
people suffered. A Guatemalan worker was
reportedly tied with duct tape and beaten with an ice hook. What?
That's illegal? (Jewish) settlers do that sort of stuff all the time
to Palestinians in the West Bank, it's no problem.

The only real surprise to many of us was that Rubashkin's Postville
Plant was producing methamphetamine. Did the Government get this part
right? We of course thought that La Kosher Nostra/Mossad would be
producing exstasy at this facility. Every one knows that Israeli's are
the number one importers of exstasy in the United States.......

Guatemalan consulate 'satisfied' with treatment of detainees

WATERLOO — A representative from the Guatemalan consulate in Chicago
called Monday's immigration raid at Agriprocessors in Postville
frightening, but said conditions inside National Cattle Congress are
humane.

Gustavo Lopez, a consul general, toured the facilities this week.
About 75 percent of detainees captured in the raid at Agriprocessors
in Postville are Guatemalan.

In a Spanish-language interview, he said the strong show of force,
combined with the name of the detention facility — National Cattle
Congress — has left many of his country's people scared. He said they
often ask if loved ones are sleeping among livestock as they await
legal proceedings.

"The name 'National Cattle Congress' sounds very dramatic," he said.
"But we were satisfied by the conditions of the facility. They know we
are watching."...........

Attorneys have complained they weren't allowed access to the detention
center until Tuesday evening.....

Lopez planned to alleviate some fears and complaints coming from St.
Bridget's Catholic Church in Postville during a visit to the church
Thursday evening. Hundreds of Guatemalans have been staying there
since Monday......

People in the church have also complained of not hearing from detained
loved ones. Lopez said he saw a list that showed 150 people who had
made calls. Some detainees have opted not to use the phones when they
are informed the calls may be traced or monitored, he said.

The attorney general's last-ditch attempt to preserve our federal
crack cocaine sentencing guidelines was pure "War on Drugs" propaganda...
The attorney general -- who some would argue might have better things
to do -- went before Congress multiple times to try to derail the
measure, employing classic White House-style fear-mongering. "Unless
Congress acts by the March 3rd deadline," he warned members of the
House Judiciary Committee in February, "nearly 1,600 convicted crack dealers, many of them violent gang members, will be eligible for
immediate release into communities nationwide." Channeling Dick
Cheney, he said, "Many of these offenders are among the most serious
and violent offenders in the federal system, and their early release
at a time when violent crime is rising in some communities will
produce tragic, but predictable results."

In fact, the vast majority of people locked up on federal crack
cocaine charges are nonviolent offenders -- with one recent analysis
by the Sentencing Commission showing the number close to 90 percent.

"Rabbi Moshe Rubashkin, new chairman of the politically wired Crown
Heights Jewish Community Council, is famous for inviting his neighbors
to a lavish annual Purim party. But Rubashkin spent his 2003 Purim in
the pokey - serving out a 15-month federal plea deal for passing
$325,000 in bad checks on behalf of his troubled textile business.On
Jan. 31, 2005 - less than a year after walking out of Fort Dix federal
prison in New Jersey - Rubashkin was elected chairman of the council,
which receives $1.9 million a year in city and state social services
and housing contracts. While no laws prevent a felon from running a
government-funded group, Rubashkin has vowed "not to handle any of the
checks" for the council, said a source close to him. Rubashkin, 46,
refused to comment through a spokesman. Rubashkin unseated chairman
Chanina Sperlin, garnering about 800 of 1,200 votes in a bitter
election that divided many in the Lubavitcher Hasidic community. Women
weren't allowed to vote. The council's leaders often play a role in
citywide politics. In 1997, Bruce Teitelbaum, chief of staff to Mayor
Rudolph Giuliani, reportedly worked to oust the council's
then-chairman Rabbi Joseph Spielman ... In 1999, Rubashkin wrote three checks from his nearly empty bank account to Montex, a
Pennsylvania-based textile company. When an associate warned Rubashkin
that he needed to cover the checks or face prosecution, he replied,
"So, I will go to jail," according to documents released by federal
prosecutors in Pennsylvania.When he passed the checks, he was being
investigated for reporting irregularities in payroll taxes, a law
enforcement source said on condition of anonymity. He was hit with a
$278,194 federal tax lien in 1997, according to city records. It's not

Montex Mills
Rubashkin was the owner of Montex Mills, a textile mill in Allentown,
Pennsylvania. It ceased operations in 2000. According to court papers
Rubashkin was involved in an offense in connection with his operation
of Montex Mills. Pennsylvania law requires companies to secure
worker's compensation insurance for their employees. Nevertheless,
when an employee of Montex became injured and attempted to recover
disability payments, it became apparent that Rubashkin, in his
capacity as president of Montex, had failed to secure the required
insurance. On May 4, 2001, Rubashkin was placed in an ARD program for
a period of 18 months. It was during this probationary period that
Rubashkin - in an attempt to liquidate some of the failing plants
assets, wrote bad checks to himself from the company, defrauding the
Banks of over $300,000.[2]

A government investigation found that between March 25, 1999 and March
30, 1999, Rubashkin attempted to deposit three checks payable to
Montex, all drawn from the account of an entity named First Choice
Associates, into Montex's First Union accounts. In the aggregate, the
three checks totaled approximately $325,000. Rubashkin withdrew or
used most of the funds which he attempted to deposit. Shortly
thereafter, First Union learned that there were insufficient funds in
the account from which the deposited checks were drawn. Rubashkin
pleaded guilty to one count of Bank Fraud under US CODE 18 § 1344,
"execution of a scheme to defraud a financial institution".[3], on
July 31, 2002, for passing bad checks to prop up his failing Montex
Mills textile business.[4] He was sentenced to 15 months in prison and
a further five years on probation. He was also given a fine of
$233,000.[5][6] He appealed the length of the sentence, but this was
rejected.[6] He served his time at Fort Dix Federal Prison in New
Jersey.[7]

The mill had been closed for more than 4 years and Rubashkin had
defaulted on his city tax payments. The city had obtained an order for
the property to be sold to raise public funds. The mill burnt down
following a series of fires attributed to arson[8] that began on April 19, 2005. The original fire burnt for over 24 hours. The fire took
place three days before the building was to be sold at a sheriff's
sale because of more than $100,000 in delinquent taxes. The mill had
not been functioning for a number of years before the blaze.[9]

The Environmental Protection Agency was forced to get a court order to
enter the site - which posed a serious public safety risk - as the
owners were uncontactable. The site contained numerous major fire
hazards including explosive aluminium powder and acids.[9]

In November 2005 the local government had obtained a court order to
repossess the building due to non-payment of back-taxes when the
building burnt down. Subsequently the majority of the ruins were
transferred from Skyline Industries to Southside Development, both
companies are believed to be controlled by the Rubashkin family,
according to local officials.[10]

In 1995, Rubashkin along with his father Aaron Rubashkin, he was found
guilty of fraudulently withholding Union remittances from organized
labor groupings that were active at the Cherry Hill Textiles Mill in
Brooklyn, that was under their ownership. The National Labor Relations Board found them guilty on a number of charges and ordered them to pay all the back-dated dues.[11]

In November 2007 Rubashkin and his son Rabbi Sholom Rubashkin were
arrested and indicted on charges of illegal storage of hazardous waste
without a permit and one count of making a materially false statement.
According to the US Department of Justice, "the allegations in the
indictment stem from defendants' ownership and operation of a textile
dyeing, bleaching and weaving business, Montex Textiles, formerly
located in Allentown, Pennsylvania.[12]

The indictment alleges that when the business ceased operations in
2002, numerous containers of hazardous waste were stored at the site without the necessary permits. After local authorities responded to
two fires that occurred at the site, the United States Environmental
Protection Agency initiated a major clean-up of the property in
October 2005, including disposal of numerous containers of hazardous
waste and hazardous substances located thereon. "The defendants were
arrested and charged with violations related to alleged involvement in
the abandonment of hazardous waste at the Montex Textile facility,"
said Susan Helbert, Acting Special Agent in Charge of the Philadelphia
Area Office for the USEPA's Criminal Investigation Division.[12]

guidelines after PETA released an undercover video showing cows'
throats ripped out with a meat hook and cows writhing on the floor,
trying to get up and run away after shechita.

Veterinarians, large animal biologists and animal welfare experts came down on PETA's side, while Orthodox rabbis supported Rubashkin.

Nevertheless, the OU promised to stop meat hook use and throat-ripping.

Two years later, Rubashkin's Gordon, Nebraska plant was found to be
using a meat hook to probe the throats of fully conscious animals. The
OU denied the instrument used was a meat hook. The OU was lying.

FailedMessiah.com obtained documents under the Freedom of Information
Act that prove the USDA now allows this type of meat hook use, even on
fully conscious animals.

The documents indicate the USDA expects this procedure to be done by
rabbis as part of the ritual slaughter, not by non-Jewish workers. Yet the USDA in practice allowed non-Jewish employees to do the procedure.

In an award-winning report by the Forward, the Postville plant was
also accused of abusing its employees.

The plant has had its share of EPA troubles, as well.

Aaron Rubashkin, the family's patriarch and president of
Agriprocessors, was sanctioned by the National Labor Relations Board
along with his son Rabbi Moshe Rubashkin. The Rubashkins collected
union dues from their Brooklyn employees but did not turn the money
over to the union. Instead, the Rubashkins kept the money for
themselves.

Another PETA undercover video shows an Agriprocessor's representative
refusing to pay for work-related medical care for a plant worker.

Rubashkin also had several food safety issues, including mishandling
of meat potentially tainted with Mad Cow Disease.

Agriprocessors refused to recognize its employees' vote to unionize.
The National Labor Relations Board found against Agriprocessors. The
Rubashkin family appealed that decision. On January 4, 2008 the United States Circuit Court of Appeals found against Agriprocessors and for the employees' unionization..

Moshe Rubashkin

Rabbi Moshe Rubashkin, a son of Aaron Rubashkin, has his own run-ins
with the law. A Convicted felon, Moshe Rubashkin was elected president
of the Crown Heights Community Council shortly after his parole. He
was indicted in September 2007 along with one of his sons for a scheme

Agriprocessors Refuses To Bargain With Union " Union Wins In Court

Agriprocessors hired illegal aliens along with documented workers.
When those workers voted to to unionize in September 2005, Rubashkin
claimed the illegals were not
"employees" protected by the National
Labor Relations Act (because they are illegals) and therefore rejected
the vote to unionize, claiming a majority of union voters were
illegals and therefore not
"employees." Rubashkin refused to bargain with the union or recognize
the vote..............

In February 2008, the United Food and Commercial Workers International
Union issued a report on massive health and safety violations at
Rubashkin's Nebraska plant, Local Pride, LLC, based on USDA documents
received by the union through the freedom of information act.

The union also released a letter from four US Congressmen written to
the acting USDA Secretary about Agriprocessors many health, safety and
humane slaughter violations.

Rabbi Sholom M. Rubashkin responded to the union's report by claiming
the union was terrorizing Agriprocessors because for the past three
years its employees had refused to unionize. Rubashkin failed to
mention the NLRB decision and court case that found that Agriprocessors had illegally restrained employees from unionizing by discarding election results that included votes from undocumented workers.

Early in January of 2008, Agriprocessors lost its legal fight against
the United Food and Commercial Workers Union.

Salmonella

Using the Freedom of Information Act, Food and Water Watch was able to
compile a list of the worst slaughterhouses in America for
salmonella,the bacteria that causes most food born infection in the
US.

Rubashkin-owned Agriprocessors in Postville, Iowa is among the worst
15% of slaughterhouses in the US, failing three separate salmonella
inspections and "passing" a fourth with the lowest possible passing
grade.

Also surfacing was a judgment against Aaron Rubashkin and his assorted
companies in the Allou Healthcare bankruptcy case. Allou executives,
Satmar hasidim from Brooklyn, pleaded guilty to fraud in this case.

Allou's court-appointed receiver sued Rubashkin and his companies,
receiving a $1.4 million dollar judgement against Aaron Rubashkin on
October 1, 2007.

Even though Allou was not in the meat business and did not distribute
food, especially refrigerated perishable food, Aaron Rubashkin's meat companies claimed to have sold Allou almost $2 million dollars worth
of meat. No trace of the meat or its distribution could be found.

It is believed the invoices sent by Rubashkin to Allou were false, and
that the money Allou paid was kicked back to the Jacobowitz family,
the executives of Allou, with Rubashkin keeping a percentage for
himself. This alleged money laundering has not â€" yet â€" been
criminally prosecuted, even though the court issued a civil judgement
against Aaron Rubashkin for $1.4 million dollars......

Car registrations, titles included in ICE investigation

An alert DOT investigator noticed a number of the suspiciously titled
vehicles could be found in the Agriprocessors parking lot, records
state.

Records allege officials uncovered a connection between the vehicles,
a supervisor at Agriprocessors and a Cedar Rapids automobile
dealership.

Dealership managers told DOT officials they were good friends with the
supervisor, who is referred to in court records only as "C," and had
sold a large number of cars to people in Postville through him.

Part of this arrangement allegedly breached Iowa law, which requires
all vehicle dealers to be licensed, court records allege.

Dealership managers told DOT investigators that "C" would call them
for a specific type of vehicle, which they would buy at auction. "C"
would then pick up the vehicle.

The cars were then sold to people in Postville but titled in
Chickasaw, Des Moines and other counties.

When questioned, one person who applied to register vehicles for
Postville residents told DOT officials he was mailed vehicle
information and money to do the transactions.

He then went to the Des Moines County Treasurer's Office to register
on behalf of the new owner but used addresses of friends in the
Burlington and West Burlington area, records state.

He then arranged to pick up registrations and titles mailed to his
friends and sent them in bulk to Postville.

Investigators also talked with an illegal worker at the plant in 2006
who said a supervisor had approached him about buying a vehicle from
him. When the worker declined, the supervisor refused to transfer him
to a more favorable job at the plant, records state.

Sholom Rubashkin of Postville, a member of the family that runs
Agriprocessors Inc., in 2006 gave $22,500 to former Rep. Jim Nussle,
R-Ia., in his bid for governor. There are no limits on contributions
to state candidates, unlike federal law.

Nussle, who lost to Culver, now is a top member of the Bush administration, serving as director of the Office of Management and
Budget.

A second family member, Abraham Rubashkin, who has addresses
listed in both Postville and Brooklyn, N.Y., gave $7,500 to the Nussle
campaign.
